Artificial Stone Silicosis Lawsuits and Legal Claims

You cut, ground, and polished quartz slabs for years. Nobody explained what was in the dust, the shop vacuum never worked right, and now a pulmonologist is saying words like “fibrosis” and “transplant.”

Artificial stone silicosis lawsuits exist for exactly this situation, and they are not the same thing as a workers’ compensation claim.

California is the center of the crisis. State public health researchers counted 644 confirmed cases among engineered stone fabrication workers between 2019 and mid-2026, including 35 deaths and 75 lung transplants. These numbers rise each week. The median age at diagnosis was 46. These are men in the middle of their working lives, and many of them worked in shops across Los Angeles County.

Legal Grounds for Artificial Stone Silicosis Lawsuits

Workers’ compensation covers medical treatment and part of your lost wages, but in exchange it usually bars you from suing your employer. That’s a poor trade when the illness is permanent. But fortunately, it is also not the end of your options.

The strongest path for most stone fabricators is a product liability claim against the companies that made, imported, and sold the slabs you cut. Two theories drive this litigation. The first is failure to warn, which asks why a product with more than 90 percent crystalline silica can reach a San Pedro fabrication shop without a warning the crew could act on.

The second is strict product liability, which asks a harder question: Can this material be cut safely at all with the tools the industry actually expects workers to use?

California regulators have started answering that. In May 2026, the state’s Occupational Safety and Health Standards Board voted unanimously to begin banning the fabrication and installation of artificial stone above 1 percent silica. Filing deadlines in California generally run two years, though for a disease this slow to surface, the clock usually starts at diagnosis, not exposure.

What Compensation Is Available in Engineered Stone Claims

A silica dust legal claim is built around the rest of your life, not around a single bad day at work. Recovery in these cases typically covers past and future medical care, the cost of transplant evaluation and the lifetime of care that follows one, plus the ongoing monitoring as the disease progresses.

Lost earning capacity is often the largest number in the file. A fabricator diagnosed at 46 is losing twenty years of skilled work, not a few months of light duty. Claims also account for pain and suffering and for what the illness takes away outside of work, from sleeping through the night to keeping up with your own kids.

Families who have already lost someone can bring a wrongful death claim, covering funeral costs, lost financial support, and the companionship that no settlement replaces.

Expert Testimony and the Work History That Proves Your Case

Manufacturers rarely argue that silica is harmless. They argue that nobody can prove their slab caused your illness. Beating that defense is the real work of an engineered stone lawsuit.

At Frost Law Firm, PC, that work starts with the experts:

  • An industrial hygienist reconstructs what the air in your shop actually held, using the tools you used, the square footage you worked in, and whether anyone ran water.
  • A pulmonologist or occupational medicine physician connects your imaging to silica exposure and rules out the conditions that silicosis is often mistaken for.

Alongside both experts sits product identification. Which brands of slab moved through which shop, in which years, while you were standing over the saw?

That is why your own records matter more than you would expect. Save your pay stubs. Save the names of every shop you worked in, including the ones that have since closed. Save any photo, invoice, or delivery slip showing a brand name on a slab.

Frost Law Firm, PC Handles Toxic Tort Claims Like These

Proving that a manufacturer knew its product was dangerous, and then proving what that product did to one worker’s lungs, is the same scientific work our firm has done in asbestos cases for nearly two decades. Scott Frost has represented victims of asbestos-related disease for over eighteen years, and artificial stone silicosis demands the same discipline: exposure histories, product identification, and experts who hold up under cross-examination. We see these cases through from exposure to closure.

Our San Pedro office is a short drive from the Los Angeles County courthouses where these cases are tried. If you worked with engineered stone anywhere in the harbor area and you have a diagnosis, talk to an artificial stone silicosis attorney before the record gets any colder.
